Persons wishing to act as investment advisors has to compulsorily registered with the market regulator Securities and Exchange Board of India (SEBI). The SEBI (Investment Advisers) Regulations, 2013 (“IA Regulations”) were notified on January 21,2013 and have come into effect from April 21, 2013. .
All the persons acting as an investment adviser before the commencement of IA Regulations are advised to make their application for grant of registration before October 21, 2013 to continue to do so and shall comply with the requirement of obtaining a certificate of registration for acting as investment adviser under the IA regulations.
In terms of the Investors Advisors Regulations, no person shall act as an investment adviser or hold itself out as an investment adviser unless he has obtained a certificate of registration from the Board or he is specifically exempt.
It is a step towards Investors protection. The new set of regulations will help to prevent unqualified investment advisors. In August itself, SEBI conducted a surprise visit on the premises of one Mr. Imtiyaz Hanif Khanda and one Mr. Vali Mamad Habib Ghaniwala.and founded that they were providing investment advice through their proprietary concerns without being registered with SEBI. They were debarred by SEBI from dealing in securities.
